Terms of service

1. Who you are buying from

amayacapetown.com is run by Maxine Benatar, trading as Amaya, a sole trader in Cape Town, South Africa. Phone and WhatsApp +27 83 703 8502. Email maxinebenatar@gmail.com. By ordering you agree to these terms and to our Shipping, Refund and Privacy policies, which form part of them.

2. Who can order

You must be 18 or older and able to enter a contract. By ordering you confirm that the details you give are accurate and that the payment method is yours to use.

3. Products

Every Amaya is made in Cape Town in a small run. Colours on screen can differ slightly from the fabric; the studio photos are the most accurate reference. Measurements in the size guide are body measurements in centimetres and can vary by a centimetre either way, as is normal for garments made by hand. We may change or discontinue a style at any time.

4. Prices and payment

All prices are in South African rand. Delivery costs are shown in your bag and at checkout before you pay. Payment is processed by Payfast on its secure pages, with the methods shown at checkout, such as card, Instant EFT and Payflex (4 interest-free instalments). Payflex instalments are a separate agreement between you and Payflex. If a price is obviously wrong (for example a missing digit) we may cancel the order and refund you before dispatch.

5. Your order

You review your order before you confirm it, as the Electronic Communications and Transactions Act (ECTA) requires. We email a confirmation when payment clears; that is when the contract is made. If we cannot supply a piece (it sold out while you were paying, or a fabric is no longer available) we tell you within 2 working days and refund you in full, or offer an alternative you can accept or decline.

6. Delivery, exchanges and refunds

See the Shipping policy and the Refund and exchange policy. In short: R99 delivery, free from R1 500, 1 to 5 working days after dispatch depending on where you are; 14 days to exchange or return, first exchange free; 7-day cooling-off right under ECTA section 44; 6-month warranty on defects under the Consumer Protection Act (CPA) section 56.

7. Made to order

Pieces marked "made for you" are cut to the size you select, not to your personal measurements, unless we agree otherwise in writing. They take 10 working days and cannot be cancelled once cutting has started, except when faulty.

8. Discount codes and early access

One code per order. Codes cannot be combined and are not valid on sale pieces unless we say so. The welcome code for a registered dress is for a first order placed directly with us. We may withdraw a code at any time; orders already placed are honoured.

9. Your account and your content

Keep your password private; you are responsible for orders placed through your account. If you send us photos or reviews you give us permission to show them on the site and on @amaya.capetown, with credit, and you confirm you have the right to share them. We remove them on request.

10. Intellectual property

Designs, photos, text and the Amaya name belong to Amaya. You may share product pages and images on social media with a link back; any other use needs our written permission.

11. Our liability

Nothing in these terms limits your rights under the CPA or ECTA. Beyond those rights, our liability for any order is limited to the amount you paid for it. We are not liable for delays caused by the courier, strikes, load shedding or other events outside our control, though we will always help you sort it out.

12. Complaints and law

Talk to us first: WhatsApp +27 83 703 8502 or email maxinebenatar@gmail.com, and we reply within 2 working days. If we cannot resolve it, you can approach the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission. South African law applies and the courts of South Africa have jurisdiction.

13. Changes

We may update these terms. The version on the site when you order applies to that order.
